The Court of Appeal issues Criminal Practice Directives pursuant to s. 2(2) of the British Columbia Court of Appeal Criminal Appeal Rules. They are intended to provide guidance in the conduct of an appeal. Practice Directives do not have the same force of law as the formal enactments in the Court of Appeal Act and Rules, but they express the view of the Court regarding matters of practice and procedure. Litigants and practitioners are expected to comply with them or show good reason for doing otherwise.
On July 11, 2022 Chief Justice Bauman issued a package of eight practice directives that apply to both civil and criminal appeal proceedings as part of the transition to the new Court of Appeal Act and Rules. These practice directives take effect on July 18, 2022. Some practice directives have been updated, some are incorporated into the new civil Rules, and three new practice directives have been issued (styles of proceedings, appearing remotely, and case compilation software). The registrar has also issued a new filing directive that takes effect on July 18th.
