The Court of Appeal issues civil practice directives pursuant to the Court of Appeal Rules. They are intended to provide guidance in the conduct of an appeal and enable the Court to regulate and control its procedure. Practice directives do not have the same force of law as the formal enactments in the Court of Appeal Act and Rules, but they express the view of the Court regarding matters of practice in the conduct of an appeal. Litigants and practitioners are expected to review and comply with practice directives or show good reason for doing otherwise.
On July 11, 2022 Chief Justice Bauman issued a package of 14 civil or civil and criminal practice directives effective 18 July 2022. Some of the Court’s practice directives have been updated, some are incorporated into the new Rules, and three new practice directives have been issued (styles of proceedings, appearing remotely, and case compilation software). The registrar has also issued a new filing directive that takes effect on July 18th.
