PRACTICE DIRECTION 7 - DISCOUNT RATES
Effective immediately, PD-7 - Discount Rate pursuant to the Law and Equity Act dated July 1, 2010 is rescinded. Information about the discount rates is available here.

DISCOUNT RATES
Under s. 56(2) of the Law and Equity Act, RSBC 1996, c. 253, the Chief Justice of the Supreme Court of British Columbia is authorized to make "regulations prescribing:
(a) a discount rate that is deemed to be the future difference between the investment rate of interest and the rate of increase of earnings due to inflation and general increases in productivity, and
(b) a discount rate that is deemed to be the future difference between the investment rate of interest and the rate of general price inflation."
The discount rate prescribed under s. 56(2)(a) is used in in calculating the present value of future damages that are intended to compensate for or are determined with reference to (a) loss of future earnings because of partial or total loss of income earning capacity, or (b) loss of dependency under the Family Compensation Act.
The discount rate prescribed under s. 56(2)(b) is used for all other future damages.
Since 1981, the discount rate under s. 56(2)(a) has been 2.5% and the discount rate under s. 56(2)(b) has been 3.5%.
Effective immediately pursuant to the Law and Equity Regulation, BC Reg. 74/2014, the discount rate prescribed under s. 56(2)(a) is 1.5% and the discount rate prescribed under s. 56(2)(b) is 2.0%.

ADMINISTRATIVE NOTICE - 11 - BANKRUPTCY PRACTICE BEFORE THE REGISTRAR - JUNE 2, 2014
Chief Justice Hinkson has issued Administrative Notice - 11 - Bankruptcy Practice Before the Registrar which will take effect on Monday, June 2, 2014.
AN-11 sets out the procedures to be followed in all hearings set before a Registrar in Bankruptcy. It applies to trustee opposed discharge applications and to bankruptcy hearings in excess of 15 minutes. AN-11 also prescribes standard forms of order for bankruptcy hearings before a Registrar in Bankruptcy. AN-11 will replace AN-9 as of June 2, 2014. Until then AN-9 remains in effect and will remain available on the Court's website.
