NEW PRACTICE DIRECTIONS - JANUARY 1, 2013
Chief Justice Bauman issued three new practice directions yesterday.
PD-38 - Request for Assignment of Judge – Insolvency Proceedings
This Practice Direction sets out the procedure and electronic form to be used by a party or counsel making requesting the assignment of a judge in insolvency proceedings.
PD – 39 – Model Discharge Order
This Practice Direction prescribes a model form of order for the discharge of a receiver appointed in a proceeding pursuant to the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3 and to section 39 of the Law and Equity Act, R.S.B.C. 1996, c. 253.
PD – 40 – Model Approval and Vesting Order
This Practice Direction prescribes a model form of order for approval and vesting orders in insolvency proceedings.
The purpose of these practice directions is to require the use of standardized form for requesting the assignment of a judge in insolvency proceedings and to require the use of model orders for certain applications in insolvency proceedings which make it easier for the parties and the court to focus on the issues that are in dispute.Â
All of the practice directions come into effect on January 1, 2013.

CPD-1 - CRIMINAL PRE-TRIAL CONFERENCE PROCESS - DECEMBER 1, 2012
Associate Chief Justice Cullen has issued CPD-1 - Criminal Pre-Trial Conference Process which takes effect on December 1, 2012.
CPD-1 - Criminal Pre-Trial Conference Process expands the Criminal Pre-Trial Conference Process to all Supreme Court registries. Some requirements of the PD apply as of December 1, 2012, and others apply as court registries are incorporated beginning in January 2013 through to March 2013. Some features of the original pilot project have been modified:
- A Crown synopsis is required to be filed for all criminal trial cases, regardless of their estimated length, and for all extradition proceedings, 7 days before the pre-trial conference or 30 days before the trial if no pre-trial conference is scheduled before then. This requirement applies in all registries as of December 1, 2012
- A new form of Crown Synopsis asks for more specific detail and separate forms of synopsis are specified for criminal trial proceedings and extradition proceedings (see Appendix A and Appendix B)
- Pre-trial conferences will be held for all criminal trial cases scheduled for 4 days or longer, and for all extradition proceedings. For criminal trials scheduled for 3 days or shorter, pre-trial conferences will only where the trial is by jury, the accused is self-represented, one or both counsel request a pre-trial conference or the Court directs that a pre-trial conference be held
- The new requirements for scheduling pre-trial conferences apply as of December 1, 2012 to all extradition proceedings and to all criminal proceedings cases in the 4 registries that were part of the pilot (i.e., Vancouver, New Westminster, Chilliwack and Kamloops) and will extend to other registries according to the staggered schedule set out in Schedule A.
